These Terms of Service (“Terms”) govern your access to and use of the 956 PALM website, directory, marketplace, and related services (the “Services”). By creating an account, browsing, listing, purchasing, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Acceptance of Terms

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or enter into paid subscriptions. By using the Services, you represent that you meet this requirement and have the authority to agree to these Terms.

2. Accounts and Registration

Keep your account credentials secure and notify us of unauthorized use.
Provide accurate, current, and complete information.
You are responsible for all activity that occurs under your account, including content posted by anyone you authorize.

3. Listings, Content, and Merchant Responsibilities

You may only list businesses, events, real estate properties, garage sales, coupons, and other content that you have the right to publish and promote.
All listing details, including hours, prices, photos, menus, and descriptions, must be truthful, lawful, and not misleading.
You are responsible for obtaining any required licenses, permits, and insurance for your business or event.
We reserve the right to review, edit, suspend, or remove any content that violates these Terms or our community guidelines.

4. Prohibited Conduct

You may not use the Services to:

Post illegal, fraudulent, defamatory, hateful, obscene, or harmful content.
Harass, spam, impersonate, or mislead other users.
Infringe intellectual property, privacy, or other rights.
Manipulate reviews, ratings, clicks, impressions, or analytics.
Introduce malware, scrape data, or attempt to breach our systems.
Use SMS or alert systems to send unsolicited or abusive messages.

5. Payments, Subscriptions, and Refunds

Fees for merchant plans, realtor memberships, garage-sale listings, advertisements, and SMS booster packs are displayed before checkout.
Subscriptions automatically renew unless cancelled before the renewal date. You can cancel in your dashboard or by contacting us.
All payments are processed by Stripe. We are not responsible for payment-processor errors.
Refunds are issued at our discretion, generally for technical errors or unused one-time listings that never went live.

6. Intellectual Property

956 PALM and its branding, logos, software, and content are owned by us or licensed to us. You retain ownership of content you submit, but you grant us a worldwide, royalty-free license to display, distribute, and promote it within the Services. You may not copy, modify, or distribute our platform or its content without permission.

7. Disclaimers and Limitation of Liability

The Services are provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or secure access.
We are not a party to transactions between users, merchants, agents, and buyers. We do not endorse listings, verify every claim, or guarantee outcomes.
To the fullest extent permitted by law, our liability is limited to the amount you paid to us in the 12 months preceding the claim, or $100 if you made no payments.

8. Termination

We may suspend or terminate your account or remove content at any time for violation of these Terms, legal requirements, or harmful behavior. You may delete your account at any time; termination does not excuse outstanding fees or prior breaches.

9. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Hidalgo County, Texas.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes become effective means you accept the revised Terms. Material changes will be announced through the Services or by email.
